Software licence
Last updated 21 October 2026
In short. Longview is ours, and you are licensed to use it, not sold it. You may download and evaluate it free of charge; using it beyond an evaluation needs a commercial licence from us. Don't copy, modify, reverse engineer, resell or work around its licensing, except where the law says you may. The open-source parts are under their own licences. Your rights under the Australian Consumer Law are unaffected. This summary is not part of the licence; the terms below are.
1. About this licence
This licence is an agreement between you and Generic Software Company, a business name registered in Australia (ABN 94 782 841 185) (we, us, our). It covers the Longview software — the workstation host, the clients and the Connection Manager, in every edition and on every platform — together with its updates and its documentation (the Software).
By downloading, installing or using the Software you agree to this licence. If you do so for an organisation, you confirm that you are authorised to bind it, and you means that organisation as well as you. If you do not agree, do not download, install or use the Software.
Where we have a separate signed agreement or an accepted order with you for the Software, it applies alongside this licence and prevails where the two conflict.
2. The licence we grant
Evaluation
We grant you a non-exclusive, non-transferable, revocable licence to install and use the Software, free of charge, for the purpose of evaluating whether to obtain a commercial licence. An evaluation is for internal testing; it does not include production use, use to provide a service to others, or use for commercial gain. We may end an evaluation at any time by notice to you, and may limit it by time or by function.
Commercial use
Any other use requires a commercial licence. A commercial licence is granted by an order, quote or agreement we accept, and by the licence key or machine licence file we issue for it, and is limited to what that order describes — for example the number of workstations or machines, the edition and its features, and the term. Subject to this licence and to payment of the applicable fees, we grant you a non-exclusive, non-transferable licence to install and use the Software within those limits, for your internal business purposes.
Copies
You may make the copies reasonably needed to install and run the Software as licensed, and to back it up.
3. What you may not do
Except as this licence expressly permits, or as the law permits despite this restriction (including the provisions of the Copyright Act 1968 (Cth) on interoperability, error correction and security testing), you must not, and must not allow anyone else to:
- copy, modify, translate or create derivative works of the Software;
- reverse engineer, decompile or disassemble the Software, or otherwise attempt to derive its source code;
- remove, bypass or interfere with its licence keys, machine licence files, licence checks or other technical limits, or use it beyond the limits of your licence;
- sell, resell, rent, lease, lend, sublicense, distribute or transfer the Software, or make it available to third parties as a hosted or managed service, unless we have agreed to that in writing;
- remove or alter any copyright, trade mark or other proprietary notice in or on the Software;
- use the Software to build a competing product, or publish benchmarks of it for that purpose;
- use the Software unlawfully, or to access systems, accounts or data you are not authorised to access.
4. Ownership
The Software is licensed, not sold. We and our licensors own all intellectual property rights in the Software, its documentation and every copy of them. All rights not expressly granted to you in this licence are reserved. Longview, Generic Software Company and their logos are our trade marks, and this licence gives you no right to use them.
5. Open-source components
The Software includes open-source components, each provided under its own licence. They are listed,
with their licence texts, in the open-source notices and in the
THIRD-PARTY-NOTICES.txt file in each download. Those licences govern those components,
and nothing in this licence limits the rights they give you.
6. Your systems and your data
The Software runs on machines you control, and sessions travel between your own devices: the picture, sound, input and clipboard of a session are not sent to us. You are responsible for the systems you install it on, for the accounts and access you configure, and for keeping your licence keys and machine licence files confidential.
The Software sends us a limited amount of information to operate: crash and diagnostic reports, and, for a licensed workstation, licence checks. Our privacy policy describes what is sent and how we handle it.
7. Updates and support
We may provide updates, but are not obliged to unless an order says so. Updates are part of the Software and are covered by this licence. Support is provided only as an order describes.
8. Fees
Fees for a commercial licence are as set out in the order, and are payable as it says. Unless the order states otherwise, fees exclude GST and other taxes, which you must also pay.
9. Feedback
If you give us suggestions or feedback about the Software, we may use them without restriction or obligation to you.
10. Term and termination
This licence lasts until it ends. A commercial licence ends when its term ends. We may end this licence by notice if you breach it and do not remedy the breach within 14 days of our notice, or immediately if the breach cannot be remedied or concerns sections 3 or 4. You may end it at any time by ceasing to use the Software and deleting it.
When this licence ends you must stop using the Software and delete every copy. Sections 3 to 6 and 11 to 15 continue after it ends.
11. Australian Consumer Law
Nothing in this licence excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded, restricted or modified.
Where the Australian Consumer Law applies and the Software or our services are not of a kind ordinarily acquired for personal, domestic or household use or consumption, our liability for a failure to comply with a consumer guarantee is limited, to the extent the law allows and at our option, to supplying the Software or services again, or paying the cost of having them supplied again.
12. Disclaimer
To the extent the law allows, and subject to section 11, the Software is provided as is and as available, and we exclude all warranties, guarantees and conditions not expressly set out in this licence, whether express or implied, including as to merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Software will be uninterrupted or error-free. An evaluation is provided without any warranty.
13. Limitation of liability
To the extent the law allows, and subject to section 11:
- we are not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, business, goodwill or data, however it arises;
- our total liability arising out of or in connection with this licence and the Software is limited to the fees you paid us for the Software in the 12 months before the event giving rise to the liability, or AUD 100 if you have paid us nothing.
14. Your responsibility to us
You indemnify us against loss, damage and costs arising from your use of the Software in breach of section 3, or from use of the Software in breach of the law, except to the extent we caused or contributed to them.
15. General
- Governing law. This licence is governed by the laws of South Australia, Australia. You and we submit to the non-exclusive jurisdiction of its courts and of the courts entitled to hear appeals from them.
- Export. You must comply with all export control and sanctions laws that apply to your use of the Software.
- Assignment. You may not assign or transfer this licence without our written consent. We may assign it, including to a company that takes over our business.
- Changes. We may update this licence. A new version applies to versions and updates of the Software released after it is published, and does not reduce the rights you have under a commercial licence already granted for its term.
- Entire agreement. This licence, with any order or agreement described in section 1, is the whole agreement between us about the Software.
- Severability and waiver. If part of this licence is unenforceable, the rest still applies. A failure to enforce a right is not a waiver of it.
- Notices. We may give notices by email to the address you gave us. Notices to us go to licensing@longview.network.
